These terms apply to all visitors, prospective clients, and clients who contact us through any channel. By clicking “I am 18 or older — Enter” on our age verification screen, you additionally represent that you have read, understand, and agree to these terms.
All services and all content on this website are intended for adults 18 years of age and older, without exception. You must be at least 18 to access this site, to make an inquiry, or to book or attend any session.
Following the U.S. Supreme Court’s 2025 ruling in Free Speech Coalition v. Paxton, age verification requirements for adult-oriented content are constitutionally permissible across the United States. We maintain an age verification gate as both a legal safeguard and a reflection of our commitment to responsible practice. By self-attesting to your age on this site, you represent and warrant under penalty of perjury that you are 18 or older.
We reserve the right to refuse service to anyone we have reasonable cause to believe is under 18, and to terminate any session immediately if this representation is discovered to be false.
Kinky & Conscious offers adult education, guided experiential sessions, and coaching related to BDSM, kink, conscious sexuality, and intimacy — for individuals and couples. Our services are educational and experiential in nature and are delivered by trained, professional practitioners.
Our services are not sexual services as defined under California law. Nothing in these terms or in the nature of our work should be construed to suggest otherwise. California’s Consenting Adults Sex Act (Penal Code §647(b)) protects consensual adult activity between private individuals; our services operate within and respect this legal framework.
All sessions take place in a private, professionally managed environment. Participation is always voluntary, consensual, and bounded by agreements established before any session begins.
Consent is the foundation of everything we do. Before any hands-on session begins:
You have the absolute right to stop, pause, or redirect any session at any time — no explanation required. Your practitioner will honor this immediately and without question. Your consent is ongoing and may be withdrawn at any moment.
Nothing in any pre-session agreement or intake document constitutes a waiver of your right to withdraw consent during a session. Ongoing, affirmative consent governs all activity.
All sessions are by appointment only. Booking is managed through HoneyBook. Upon booking confirmation:
Specific payment and cancellation terms applicable to your session will be detailed in your HoneyBook booking agreement, which governs in the event of any conflict with this general policy.
We take your privacy and discretion seriously. We will not disclose your identity, the nature of your inquiry, or any details of your session to any third party without your explicit written consent, except as required by law (e.g., a valid subpoena, mandatory reporting obligation, or imminent safety concern).
We ask that clients extend equivalent courtesy to us: please do not share the personal details, home address, or identifying information of our practitioners or the session location without our express written consent. Breach of this obligation may result in civil liability.
Confidentiality agreements (NDAs) covering the specifics of any session are available upon request and are legally enforceable under California contract law.
You are responsible for disclosing, prior to your session, any physical or mental health conditions, medications, injuries, or limitations that may affect your ability to safely participate in agreed-upon activities. This includes but is not limited to cardiovascular conditions, joint or muscle injuries, anxiety or PTSD triggers, blood thinners or anticoagulants, and skin sensitivities.
We will take reasonable precautions to ensure your safety and will tailor session activities based on your disclosures. However, you acknowledge that BDSM and kink activities carry inherent physical risks, including bruising, rope marks, and temporary physical discomfort, even when performed safely by experienced practitioners.
By booking and attending a session, you represent that you are voluntarily choosing to participate with full knowledge of these risks, and that you are physically and mentally capable of doing so at the time of the session.
The following conduct is strictly prohibited and will result in immediate termination of a session, forfeiture of any payment, and potential permanent refusal of future service:
We reserve the right to pursue civil remedies for conduct that causes harm, including but not limited to unauthorized recording or disclosure of confidential information.
All content on kinkyandconscious.com — including text, design, photography, branding, course materials, and instructional content — is the property of Kinky & Conscious LLC and is protected by U.S. copyright law. No content may be reproduced, distributed, sold, or used for any purpose without express written permission from Kinky & Conscious LLC.
To the maximum extent permitted by California law, Kinky & Conscious LLC’s total liability for any claim arising from or related to your use of our services shall not exceed the amount you paid for the specific session giving rise to the claim.
We are not liable for indirect, incidental, consequential, punitive, or special damages arising from your use of our services or website.
California limitation: Under California Civil Code §1668, a contract may not exempt a party from liability for willful misconduct, gross negligence, or violation of law. Nothing in these terms limits our liability for such conduct. This limitation applies only to ordinary negligence and unforeseen risks inherent to consensual activities.
You voluntarily choose to engage in BDSM and kink activities with full awareness that such activities involve inherent physical and emotional risks. By agreeing to these terms and signing a session consent agreement, you expressly assume the risks of ordinary negligence inherent in consensual BDSM practice — including impact play, restraint, sensation play, and related activities — to the extent permitted under California law.
This assumption of risk does not extend to risks created by practitioner misconduct, failure to honor established safewords or limits, or any activity not included in your signed consent agreement.
These Terms of Service are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Before initiating any formal legal proceeding, you agree to contact us at hello@kinkyandconscious.com and give us 30 days to attempt to resolve the dispute informally. This does not waive any statute of limitations or limit your rights if informal resolution is not reached.
If a dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Los Angeles County, California. Class action waivers are included: disputes shall be resolved on an individual basis only. Nothing prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
If any arbitration provision is found unenforceable, disputes shall be resolved in the state or federal courts of Los Angeles County, California, and you consent to personal jurisdiction in those courts.
We reserve the right to update these Terms of Service at any time to reflect changes in law, our services, or industry standards. The “Last updated” date reflects the most recent revision. We will post material changes on this page. Continued use of our site or services after the effective date of any change constitutes your acceptance of the updated terms.
